Definitions

Warranty Certificate Meaning :

The warranty certificate is the proof of contract with us, which should be read carefully and maintained in a safe place against our acceptance of the relevant warranty amount. In case of any breakdown during the warranty period shown in the certificate particulars table, we shall cover thereof as shown in the following pages.

Scheme Provider and Manager :

AAA Warranty Services Company LLC. through its commercial agent in Kuwait / Kuwait Insurance company.

Service Provider :

AAA Warranty Services Company LLC, referred to hereinafter as “We – AAA”.

Authorized Agent :

The dealer authorized by the manufacturer assigned for repairs.

Client :

Car Owner as shown in the registration document, referred to hereinafter as “You – Your”.

Extended Warranty :

Extending the manufacturer’s warranty by adding another period or an additional number of kilometers for protecting the client against the losses resulting from mechanical and electrical faults occurring suddenly due to sudden breakdown, excluding tear and wear because of usage within the coverage territory, represented in country of issuance.

Mechanical fault :

shall mean repairing or replacing any part covered hereby.

Normal Tear and Wear :

shall mean the parts vulnerable for normal and gradual tear and wear due to service life or car mileage. Extensive or Excessive Usage shall mean the usage of the vehicle beyond the average annual standard vehicle usage in the country of issuance.

Scheme Program :

You have to pay the certificate price as a condition for utilizing the service scheme.

Certificate :

It shall include the coverage particulars of the purchased car that should be read in the mainstream of certificate particulars table.

Certificate Particulars Table :

It shall be annexed with the warranty certificate and should include your details and the details of car and granted coverage as per the certificate, in addition to the warranty period. Therefore, the correctness of information shown in the certificate particulars table should be verified and should fulfill your requirements. Otherwise, you shall promptly contact the official or agent procuring such certificate.

Terms and Conditions

Coverage Commencement :

It shall start at the date of manufacturer’s warranty expiry.

Scheme Eligible Cars :

The cars sold by the authorized agent for the personal and family usage.

Limitation of liability for the repair costs :

The scheme covers repairing or replacing the covered parts as and when necessary. Warranty shall not cover car abuse, loss of time or damage for the personal properties, loss of revenues or other accidental damages. in all cases cost of repair must not exceed the market purchase value of the vehicle at time of the claim.

Repair :

The repairs as per the warranty may be performed at any of the service centers of the seller or warrantor.

Note :

The warranty may not be revoked for refund and can’t be transferred to another car.

Transfer of ownership :

Subject to the company’s approval this certificate may only be transferred to new owner under the below conditions:

  • Payment fee of 30.00KD.
  • Carried out the periodic maintenance as per manufacturer and dealership recommendations.
  • Passed the inspection of the vehicle without any malfunction noticed.
  • Transfer of ownership does not mean policy transfer unless meeting all above conditions.

Lost book issue :

A duplicate certificate will be issued for the lost warranty booklet with issuance fee if the customer comply to the terms and conditions of the booklet

Exclusions : This certificate shall not cover the following risks

  • Malfunctions resulting from manufacturing damage, design defects or included in any recall campaigns.
  • Mechanical malfunctions clearly existing before commencement of certificate.
  • Any warrantied parts but did not fail unless required by the engineering actions.
  • Normal service and maintenance.
  • Any defects resulting from manipulation, disconnection or change of mileage gauge (This will void the certificate).
  • Any malfunction in the covered parts resulting from failures of uncovered parts.
  • Any malfunction or damage to the covered parts for replacement or variation or manufacturing specifications.
  • Any legal responsibility in connection to the deaths, bodily injuries, damages to other properties or any damages resulting from natural reasons, whether directly or indirectly.
  • Any repairs, malfunctions, failures or legal responsibility covered by any other valid insurance or warranty.
  • Any defaults resulting from wars, invasion, acts of foreign enemies, hostilities, whether the war is declared or not, civil wars, military rebellion, any act or military or usurped power.
  • Any direct or indirect malfunction resulting from or caused by nuclear fuel or any nuclear waste resulting from combustion of nuclear fuel or any other reasons, such as corrosion and exterior breaks caused by fragments of stones or gravel, or resulting from any impact, discoloration or removal of paint, caused by exposure to insects, asphalt, acid rains, sunbeam, body cracks, exposure to tempests, lights, industrial wastes or contamination.
  • Greasing, filters, defrosting, cooling or any malfunction resulting from overheat, frost and corrosion.
  • Any malfunction resulting from engine overheat.
  • Any malfunction resulting from excessive usage, inadequate maintenance, negligent treatment, significant accident or total loss or misuse.
  • Any modifications, device or accessories installed by other than the authorized agent and any malfunction and its consequences.

Car Maintenance

Client’s responsibility for the extended warranty scheme:

  • Client shall be responsible for maintaining the warranty by keeping the car service and repair inside the agent’s service center.
  • Reporting any defaults on occurrence to avoid any collateral damages.
  • Keeping all documents and invoices for evidencing regularity of periodical maintenance.

Note :

Failure of car service shall invalidate the eligibility for such scheme and to avoid the risk of denying any repairs, kindly maintain the periodical maintenance and service at the authorized agent as stated in the manufacturer’s instructions.

Repair methodology :

  • As far as possible, the damaged part should be repaired and in case improper or defective, the originally refurbished spare parts should be used; otherwise, new original parts should be used.
  • Replacement of assemblies only in the following events:
  • Disassembling and examining the parts that could not be repaired.
  • The cost of repairing / replacing defective parts / elements shall be higher than the cost of replacing the assembly in entirety.
  • In case the authorized agent’s service center could not repair the assembly, the service provider, AAA, may repair thereof at another service center, provided such assembly shall be covered to expiry of warranty.

Taxes

The customer shall pay to the company, as of the start date and throughout the life of this agreement, all direct taxes, evaluations, fees, and duties related to the sale of this certificate including but not limited to the value added tax (VAT) which this agreement is or might be subject to due to changes in the laws interim of the life of this agreement and any fees or taxes levied by operation of the law during the effective life of this agreement or its renewal that the customer will incur, with exception to taxes or fees levied on the profits achieved by the company from this agreement ( Company income tax is the company’s liability). The Value Added Tax is imposed on the customer in the country that has implemented and levied it wherever it is in effect.

Repair Procedures

For car owner :

In case of any failure, signs of failure or risk of failure covered hereby, the car owner or representative thereof shall take the following actions:

  • Take the car to the authorized dealer’s service center or any of the company branches.
  • Provide AAA policy to the authorized dealer.
  • Let the agent have access to the warranty pamphlet (contract) and service logs.
  • Ask the agent to diagnose the problem and provide an estimate for repair costs.
  • In certain events, you may be asked to permit the service center to disassemble The car for identifying the reason of default and repair costs and you will be responsible for such costs in case the scheme does not cover the default. You shall reserve the right of examining the vehicle before commencement of repair.
  • The covered repair costs shall be directly reimbursed to the agent of repair workshop.

Note :

  • You shall note that there could be monies payable by you not stated in the repair order statement. Therefore, you should settle thereof directly with the agent.
  • In case repairs were performed by any agent other than the authorized dealer, you may be required to pay the costs of repairs and recover the repair costs from AAA.

For repairer :

  • Before any repairs, the prior consent of AAA should be obtained.
  • You should ensure providing the following documents: - Policy copy - Ownership copy - Job card - Service invoices - Repair estimate Parts and Labor.
  • AAA management shall provide the repair authorization number that should be shown on the repair bill or any future communications.
  • You will be provided with an authorization form to ensure the repair order details.
  • On receipt of permission, you can commence repairs.
